Welcome to NxGenNexus, a product of NxGeneration, LLC ("Company," "we," "our," or "us"). By accessing or using our platform — including our web application, mobile application, and related services (collectively, the "Service") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
You must be at least 18 years old to create an account and use the Service on your own behalf. If you are using the Service on behalf of a school, athletic organization, or other institution, you represent that you have authority to bind that entity to these Terms.
Student and minor athlete data may be entered into the platform by authorized school or organization staff. Such data is protected under applicable law including FERPA and COPPA, and the organization bears responsibility for obtaining necessary consents.
NxGenNexus provides a multi-sport and academic management platform for high schools, athletic organizations, coaches, students, and parents. Features include roster management, game scheduling, playbook design, film review, academic tracking, grade monitoring, attendance, and related tools.
You agree to provide accurate, current, and complete information when registering for an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
Access to certain features requires a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually) as selected. All fees are non-refundable except where required by law. We reserve the right to modify pricing with at least 30 days' notice.
Failure to pay may result in suspension or termination of your account. Payment processing is handled by Stripe, and by providing payment information you agree to Stripe's terms of service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to data practices described in the Privacy Policy.
You retain ownership of all data you input into the Service ("Customer Data"). You grant us a limited license to process and store Customer Data solely to provide the Service to you.
The Service and all its original content, features, and functionality are and will remain the exclusive property of NxGeneration, LLC and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Service without prior written consent.
You grant NxGeneration, LLC a non-exclusive, royalty-free license to use aggregated, anonymized data derived from your use of the Service for product improvement and analytics purposes.
The Service may integrate with or link to third-party services (e.g., Hudl, YouTube, Stripe, AI providers). We are not responsible for the content or practices of third-party services, and your use of them is subject to their own terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NXGENERATION, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless NxGeneration, LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising from your violation of these Terms or your use of the Service.
We may suspend or terminate your access to the Service at any time for cause, including violation of these Terms, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service immediately ceases.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Texas.
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or a prominent notice within the Service. Continued use after changes constitutes acceptance.
